Acceptable Use Policy

Terms of Service and Scope

This Acceptable Use Policy ("AUP") governs the use of all internet services provided by our company, including managed Wi-Fi, fiber-to-the-home, and all residential and commercial internet connections. By using or subscribing to our Service, you agree to abide by this AUP as part of your terms of service. This AUP applies to all users of our network, whether you are a direct customer or an end-user obtaining access through a bulk or managed Wi-Fi arrangement. You are responsible for ensuring that anyone who uses the Service through your account or network also complies with this AUP. All use of the Service must comply with applicable local, state (including Alabama or Florida law, as relevant), and U.S. federal laws and regulations, as well as with the conditions outlined below.

Security Guidelines

We are committed to maintaining a secure and reliable network for all users. Security is a shared responsibility between the ISP and the customer:

Customer Network Security: Users are solely responsible for the security of any devices and networks they connect to our Service. You should take precautions to secure your Wi-Fi networks and computers against unauthorized access, malware, and other threats (e.g., use strong passwords and up-to-date antivirus/firewall software). If you become aware of any unauthorized use of your account or a security breach, you must notify us immediately.
No Hacking or Unauthorized Access: You may not use the Service to breach or attempt to breach the security of any account, network, server, or other system. This includes unauthorized access, port or vulnerability scanning, sniffing, monitoring of data without authorization, or any form of hacking. Attempting to circumvent user authentication or security measures of any network or account is strictly prohibited.
Network Integrity: Do not engage in activities that compromise the integrity or normal performance of our network or any other network. You must not distribute viruses, Trojan horses, worms, malware, or any harmful code via the Service. Any action that interferes with or disrupts the Service or the networks of others (such as denial-of-service attacks, network flooding, or mail-bombing) is forbidden.
Provider Measures: We employ industry-standard network management and security measures to protect our network and customers. These measures are in place to ensure all users have a safe and high-quality internet experience. You must not interfere with or circumvent any security or network management mechanisms put in place by the provider.

Acceptable Usage

Our internet services are provided for lawful, appropriate, and reasonable use by our customers:

Lawful Purposes Only: You may use the Service for any legal purpose that adheres to this AUP. Permitted usage includes typical residential or business activities such as web browsing, email, streaming, online gaming, and other internet-based services, so long as such use is lawful and does not violate any section of this Policy.
Personal and Internal Use: Our residential services are intended for personal, household use, and business services for the legitimate internal needs of the subscribing organization. Resale or sharing of the Service outside your household or organization is prohibited without our explicit written consent.
Fair Usage: Our network resources are shared among users. To ensure all customers have a good experience, extremely high-volume or continuous usage that unreasonably impacts the network or other users may be subject to network management or intervention.

Prohibited Activities

To protect our customers and network, certain activities and types of content are strictly prohibited on our Service. Engaging in any of the actions below, or facilitating others in doing so, constitutes a violation of this AUP:

Illegal or Unlawful Use: Using the Service for any purpose or transmitting any material that violates any law, regulation, court order, or legal mandate is strictly forbidden.
Intellectual Property Infringement: Uploading, downloading, posting, or distributing copyrighted material, trademarks, or proprietary content without the owner’s permission.
Offensive or Harmful Content: Disseminating material that is obscene, exploitative, pornographic, defamatory, harassing, or otherwise objectionable and unlawful.
Fraudulent or Deceptive Practices: Engaging in scams, phishing schemes, impersonation, forging headers, or any practice intended to defraud, deceive, or mislead others.
Security Violations and Network Abuse: You must not use our Service to compromise security or disrupt networks. Prohibited actions include hacking, unauthorized access, cyber-attacks, or malware distribution.
Spam and Malicious Email: You may NOT use the Service to transmit unwanted emails, text messages, or other electronic messages in bulk.
Resale or Unauthorized Sharing: You are not allowed to resell, share, or redistribute our internet service to unauthorized third parties.

Enforcement and Monitoring

We take violations of this AUP seriously. If you violate this Policy or if your use of the Service is suspected to be in violation, we reserve the right to intervene and take appropriate action. Our enforcement measures may include, but are not limited to, the following:

Investigation of Violations: We may monitor network traffic and usage patterns in accordance with applicable laws to investigate suspected violations.
Warnings and Notice: In most cases of AUP violations (especially minor or unintentional ones), we will attempt to notify you and request prompt correction of the issue.
Suspension or Termination of Service: For serious or persistent violations, or if we determine in our sole discretion that your actions pose an immediate risk, we may suspend or terminate your service without prior notice.
Network Management Actions: We may employ network management techniques to ensure fair access for all users. If your usage negatively impacts the network, we may temporarily slow down your connection, filter certain kinds of traffic, or otherwise manage the flow of data until the issue is resolved.
Legal Actions and Reporting: If we believe that a violation of this AUP involves illegal activity, we will report such conduct to the appropriate law enforcement authorities.

Liability and Disclaimers

By using our Service, you acknowledge and accept the following disclaimers and limitations of liability:

No Liability for User Actions: You are solely responsible for all acts or omissions that occur under your account or via your internet connection.
Service "As Is": We provide the internet Service on an "as is" and "as available" basis. We do not guarantee uninterrupted service, error-free operation, or absolute security.
No Warranty of Privacy or Security: We make no guarantee of privacy for data transmitted or stored on our network. Although we employ security measures, no network communication is 100% private or secure.
Limitation of Liability: We shall not be liable for any indirect, incidental, special, punitive, or consequential damages resulting from your use of the Service.

Modifications to this Policy

We reserve the right to modify or update this Acceptable Use Policy at any time, at our sole discretion. Updates will be effective immediately when posted on our website. Your continued use of the Service after an updated AUP has been posted constitutes your acceptance of the revised terms.
